TBV maintenance company
Evidence of possible fraud, defamation of character,
& psychological trauma caused by erroneous accounting & invoicing
legal matters
In 24th March 2021 i received a court order via an agent of TRNC lawcourts
for unpaid debts to OTBVOA for £450
I decided to settle this amount on the day of receiveing the order
and collected a dated stamped paper receipt, and an electronic equivalent
for payment.
I had to pay £450 for outstanding fees + £50 court document charges.
(I have in my possession all OTBVOA receipts & the Court order)
In July 2021 I paid a further £490 (7 months back fees) to OTBVOA.
This details that I had "paid until September" 2021.
A further communication received via E-mail for OTBVOA Oct 17th 2021
assures that their organisation is legal and that they are the legitimate
maintainance company for Turtle Bay Village.
(OBTVOA17-10-21.pdf)
I received a further invoice from OTBVOA for outstanding debt for Q4 21 for £210
(OTBVOA-10-21.pdf)
I was advised by Nigel Sone that further payments should be postponed
because the legal situation concerning the 2 competing maintainance companies / commitees
was still in progress. I was assured payments would be re-established once the legal
situation was concluded & clarified. I have had no communication to suggest otherwise.
On the 26th September 2021 I received another demand for £1,411 from the other
maintainance company "TBV Esentepe".
The demand breaks down into 2 areas
£1,260 for unpaid maintenance fees from 2020-2021
£151.20 - a "late payment fine"
There was also a further demand from TBV
for the Q4 payment of £181.50
this bill breaks down as following
Oct maintainance fee £50
Nov maintainance fee £50
Dec maintainance fee £50
There are also more late payment fines
Fine Late payment interest charge January 10% - £15
Fine Late payment interest charge February 10% - £16.50
(see 26-09-21.pdf attached)
As you may be able to tell:
The amount demanded from TBV does not correspond with the amount owed to OBVTOA
as i was paying in maintenance fees to them in July 2021, (still owing an outstanding £140)
The 29-9-21 email (TBV-26-09-21.pdf) also presents a Beledayir tax bill which in a further e-mail
sent the next day (TBV-30-9-2021.pdf)
is detailed as being part of the maintenance service, of which i have not agreed to.
I have always paid my Beledayir taxes direct from my Co-Op account in Esentepe.
The amount detailed in this new invoice (TBV-30-9-2021.pdf) is
dated for the period 2020-2021 to the amount of £1260
This amount differs with no attempt at an explanation to the previous invoice
received in Sept 2021 of £1411.
The late fees fines seem to have disappeared.
somehow the total debt as of June 2022 TBV have calculated is
£1,892.70
which is a total of 37.84 months = over 3 years maintenance fees.
as per the evidence I have of receipted payment up to Sept 2021
in total the amount of maintenance fee arrears should be from
Sept 2021 to the present (August 2022)
If we are to include August 2022 in this bill it
should be 11 months (£550)
This figure is a fraction of the amount TBV are demanding from me and means their invoices are
clearly inaccurate, if not entirely fraudulant.
I fail to see how TBV an entity who were not functioning in 2020 as a maintenance company
or providing any services and the other group OBVTOA could have demanded any maintenance fees for
the majority of the summer 2020 - This period also comprised of a long period of Covid 19 Lockdown,
in which no one was legally allowed to work on the Village site in any capacity whatsoever.
This last fact led me to withdrawing my initial payment to OBVTOA for the same reasons, but on the
production of a court order and legal advice I decided to settle the outstanding debt as an act of good faith.
If these documents are to be intepreted correctly it appears that
TBV are attempting to charge me for over a year (£1260) in maintenance fees (2020-2021)
These are clearly services already provided by OBVTOA that I have already paid for.
The e-mail sent TBV-26-09-21.pdf
TBV details a plan to reveal non payers as consistent "trouble debtors" on social media.
This was set into motion and resulted in my name and the TBVs innacurateand misleading
debt being revealed to the general public.
The dissemination of innacurate information on social media that seeks to defame & discredit an individual
that also causes harm in any way is in fact a crime in the TRNC.
I have been approached by residents & neighbours and confronted about a debt that is either miscalculated in error
or is an attempt to defraud me.
These residents are doing this because of misinformation deliberately placed on social media by a group of people
still seeking to gain full legal status as a maintenance company.
This has caused me anxiety & worry & a general feeling of unease mistrust & gossip is now evident
in the Turtle bay Village community.
What the TBV maintenance company have done is simply counterproductive, harmful & wrong.
The last few years have been tough on most of us here in North Cyprus.
The covid lockdowns have meant many have not been able to work as they once did.
Add to this the exchange rate for the UK pound to lira which has seen anyone with
Lira only in their bank accounts in a precarious situation
Having to pay their maintainence in UK money seems ridiculous...This is not the UK
The UK money is not Turkish legal tender. Hence the need for Exchange beaureus.
I think it is high time the practice of charging rent & manitainance fees in Stirling etc
has to stop for the sake of the people who actually deal in Turkish/Cypriot life here.
I ask you to consider the following - If you made sure you tried to pay your bills leaving your bank
account precariously low for the long term, only to have the same bills placed at your door by a different company -
even though you have the proof you have paid - what would you do?
Would you trust the old maintenance company or this newer organisation?
I find myself confused with no information to make a sound judgement.
I am faced with a conundrum; if i settle my current outstanding debts & then the company known as TBV may well dissolve
and yet another company made up of unqualified people may well start demanding these very same amounts of money all over again.
At this current time, as the economy becomes worse & worse - Is there anything to suggest this would be otherwise?
On the other hand - I do beleive you have done a very good job in 2022.
If you would be willing to reappraise my outstanding debt and apologise for the awful way i have been
treated regarding this complete error in invoicing & spreading it on social media.
I would be able to consider starting to pay off my debt to you.
